On this day (March 13, 1925) Austin Peay, Governor of Tennessee signed the Butler Act which forbade school teachers from denying the Genesis Creation story. It was permitted to teach that plants and animals had evolved but it was illegal to teach that man had evolved from lower forms of animals.
In July the same year the law was tested in the Scopes Monkey Trial.
85 years later and the the fundies are still denying evolution.

I'm only guessing, but I'm pretty sure there are federal laws that override State Laws in this (and many other) areas.
From what I've heard in recent years, the Creationists have lost every time they have tried to get Creationism taught in the schools - but they just start a new campaign and the whole thing starts all over again.

Why does anyone search for a law on this subject? The parents have the right to teach any subject they want to their kids. My parents were very religious but when I entered a private boarding school, I found "Origin of the Species" and I found the truth. I never discussed this evolution at home as it would have destroyed my weekends. I learned more about the human development in books. TV had not been developed and we lived 2 blocks from the Santa Monica library. Books became my private education. Today even in adult developments, few read anything unless it is mentioned on Oprah. There is no academic curiosity and it frustrates those of us who still read.
We had no TV when my kids were little and I intoduced them to fantasy and Science Fiction and immediately saw their minds expand into science and the possible development of other planets in our universe. We lived fairly close to the observatory and would spend many Sundays in the theater to watch the stars projected on the ceiling. We also visited the Los Angeles Zoo. The beaches in Santa Monica were where we played volleyball and read. I saw so many of their friends fall into the terrorism of God and their minds were turned off to learn anything not in the bible.
Rational minds start at home.
